Terms of Service (User Agreement)

Introduction to the User Agreement: Jamalk Store welcomes you. Below you will find the terms and conditions governing your use of Jamalk Store and all legal implications arising from the use of its online services. Any person’s use of the store—whether as a consumer or user of a product/service—constitutes an explicit agreement and acceptance, while legally competent, of all articles and provisions of this Agreement. This Agreement applies to all types of transactions between the User and the Store (excluding personal status matters and real estate transactions). This Agreement becomes effective and binding upon your acceptance and registration in the Store, in accordance with Article 10 of the Saudi Electronic Transactions Law.

Article 1 - Introduction and Definitions: The above preamble is an integral part of this Agreement. Below are the definitions of key terms used:

1. (The Store): Refers to Jamalk Store, including all its online forms (mobile application, website, or commercial establishment).
2. (The User): Refers to any consumer who purchases a product or service from the Store via its online platform.
3. (The Agreement): Refers to the terms and conditions of this User Agreement, which governs the relationship between its parties.

Article 2 - User’s Legal Capacity:

1. The User acknowledges that they possess the legal capacity to deal with the Store, and that they are at least eighteen (18) years of age.
2. The User agrees that in the event of violating this article, they shall bear the consequences before third parties.

Article 3 - Nature of the Store's Obligation:

1. The Store's obligation to consumers or users is to provide the requested (Service or Product).
2. The Store may provide other relevant services, such as after-sales services, depending on the nature of the requested Service or Product.

Article 4 - Usage Controls:

1. The User commits to using the Store's electronic platform in a manner consistent with public morals and the applicable laws in the Kingdom of Saudi Arabia.
2. The User commits not to use any purchased product or service in a manner that violates public morals and the laws of the Kingdom of Saudi Arabia.

Article 5 - Accounts and Registration Obligations: Upon applying to join the Store as a User, you must disclose specific information and choose a username and secret password to access the Store's services. By doing so, you agree to the following:

1. You are responsible for maintaining the confidentiality of your account information and password, and you agree to immediately notify the Store of any unauthorized use or breach of your account.
2. The Store shall not be liable, under any circumstances, for any direct or indirect (material or moral) loss resulting from the disclosure of your username or password.
3. You commit to using your account personally and bear full responsibility for it. If another party uses it, it is presumed that you have authorized them to use the Store in your name.
4. You commit to using the Store with seriousness and credibility.
5. You must provide true, accurate, current, complete, and legal information about yourself during registration and update it if changes occur.
6. The Store commits to treating your personal and contact information with strict confidentiality.
7. The Store reserves the right to suspend, freeze, or cancel your account if it is discovered that you provided false, outdated, or illegal information, without prejudice to the Store’s rights to protect other users.
8. Failure to comply with the above gives the Store the right to suspend or block your access to the services.

Article 6 - Electronic Communications & Official Channels:

1. The parties agree that communication will take place via the email registered in the Store.
2. The User agrees that all electronic agreements, notices, statements, and communications are legally equivalent to written ones.
3. The User agrees to receive communications and notifications regarding this Agreement via general or targeted messages broadcasted by the Store.

Article 7 - Amendments to the Agreement and Fees:

1. The Store may notify you of any amendments to this Agreement via official communication channels. Such amendments may increase your obligations or decrease your rights.
2. If you object to any amendment, please cease using the services. Accessing your account or browsing the Store constitutes full acceptance of the amendments.
3. All fees are calculated in Saudi Riyals (SAR). The User must pay all due amounts along with any additional expenses determined by the Store via approved payment methods.
4. The Store may impose additional fees or government taxes depending on the nature of the product or service.
5. The Store reserves the right to add, increase, decrease, or deduct any fees under this Agreement.

Article 8 - Payment Services:

1. The Store, through its partners, provides an entirely online payment system via the available payment options.
2. The Store prices its products and services according to standard market value.
3. The Store commits to providing the User with a purchase invoice.

Article 9 - Personal and Transaction Information:

1. The User grants the Store an unlimited, global, permanent, and irrevocable right to use personal information or materials provided via registration forms or communication channels to serve the Store's interests.
2. Confidentiality of user information is governed by the Store’s "Privacy and Confidentiality Policy".

Article 10 - Intellectual Property:

1. The Store retains full ownership of its intellectual property rights.
2. The User must respect the Store’s intellectual property rights, including the name "Jamalk Store", logos, words, and symbols displayed on the platform.

Article 11 - Store's Liability:

1. The Store conducts its business legally and in accordance with the applicable laws of the Kingdom of Saudi Arabia.
2. The Store is not responsible for any claims arising from errors or negligence caused directly, indirectly, or accidentally by the User or third parties such as "shipping companies".
3. The Store ensures that the (Product or Service) is sound, legitimate, and authorized under Saudi laws to be used for legitimate purposes.

Article 12 - Confidentiality of Information:

1. The Store implements technical and organizational standards to protect Users' personal data and prevent unauthorized access.
2. The User acknowledges that the Internet is not 100% secure, and total confidentiality cannot be guaranteed.
3. The Store has no control over the actions of third parties (e.g., external links).
4. The User agrees that the Store may use their information to provide services and send marketing messages, subject to the "Privacy Policy".

Article 13 - Restriction of Access or Membership: The Store may suspend, cancel, or restrict the User’s access to the Store’s services at any time, without prior notice, and for any reason.

Article 14 - Exchange Policy:

1. The consumer has the right to exchange the product within seven (7) days of receipt. Exchange is not permitted after this period.
2. To qualify for an exchange, the product must be in its original, intact condition and unused. The Store reserves the right to inspect the product.
3. The consumer may not exchange products in the following cases:

• Products manufactured upon consumer request or customized specifications (unless defective).
• Video tapes, CDs, DVDs, or software that have been used.
• Newspapers, magazines, books, or publications.
• Products damaged due to consumer misuse.
• Digitally downloaded software/products.

Article 15 - Return Policy:

1. The consumer has the right to return the product within three (3) days of receipt. Returns are not permitted after this period.
2. To qualify for a return, the product must be in its original, intact condition and unused. The Store reserves the right to inspect the product.
3. Returns are not permitted under the same exceptions listed in Article 14 (Clause 3). For more details, please review the Store's detailed Exchange and Return Policy.

Article 16 - Applicable Law: This Agreement is governed by and drafted in accordance with the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia.

Article 17 - General Provisions:

• If any article or clause in this Agreement is deemed invalid, it does not invalidate the remaining clauses.
• This Agreement constitutes the framework of understanding and contracting between the Store and the User, noting the following:

1. The Arabic language shall prevail in interpreting or translating this Agreement.
2. Prices of services or products are subject to modification at any time.
3. Promotional offers are temporary; the Store reserves the right to modify or terminate them at any time.
4. Parties commit to conducting transactions in compliance with Islamic Sharia rules and applicable laws.
5. This Agreement can only be canceled by a decision from Jamalk Store’s management.
